Paul Terdal et al. v. Sejal Hathi et al.
On August 5, 2025, a federal lawsuit was filed on behalf of Do No Harm’s visiting fellow and member, Paul Terdal, against state officials of the Oregon Health Authority (OHA) in connection with their refusal to disclose records responsive to Terdal’s requests for public-use data concerning treatments for sex transitions. The case alleges that OHA officials retaliated and refused to disclose the records on account of the state’s viewpoint discrimination in violation of the First Amendment.
A second lawsuit was filed in Oregon state court against the Oregon Health Authority on July 21, 2026. The state suit similarly seeks to compel OHA’s disclosure of the records in accordance with Oregon state law.
