American Accountability Foundation v. National Institutes of Health et al.
On October 22, 2025, the American Accountability Foundation (AAF) filed a lawsuit seeking data from a taxpayer-funded study on the efficacy of puberty blockers to treat children with gender dysphoria. The study was funded by a National Institutes of Health (NIH) grant – the largest ever given on this topic – and helmed by Dr. Johanna OIson-Kennedy, who formerly led the pediatric gender clinic at Children’s Hospital Los Angeles.
AAF filed a public records request under the Freedom of Information Act (FOIA) for Olson-Kennedy’s 2015 study, which she previously refused to disclose. The NIH likewise declined to disclose the data.
In January 2025, NIH explained and confirmed that it does not have the data because investigators don’t report raw data to NIH as part of their progress reports.
Since one of the purposes of the case was to force NIH to say whether it had the data—which we could not ascertain during the administrative proceedings because NIH refused to communicate—Do No Harm achieved what it set out to do in supporting this case.
