On August 1, 2023, Do No Harm, joined by Dr. Marilyn Singleton and Dr. Azadeh Khatibi, filed a federal lawsuit challenging a California law that requires all continuing medical education (CME) courses to contain curriculum that includes teaching “implicit bias.”

The controversial legislation was passed in 2019 and went into effect on January 1, 2022.

However, under the First Amendment to the United States Constitution, the government may not compel physicians and CME instructors to engage in discussions on subjects they prefer to remain silent about. Nor may it condition a speaker’s ability to offer courses for credit on the requirement that she espouse the government’s favored view on a controversial topic.

This case seeks to vindicate these important constitutional speech rights.
