UPDATE: Pfizer formally ends discrimination in fellowship program, resolves lawsuit by Do No Harm

Do No Harm sued Pfizer for racially excluding whites and Asians from its Fellowship in violation of federal civil-rights laws. Do No Harm moved for a preliminary injunction to stop Pfizer’s racial exclusion and Pfizer opposed that motion. The district court dismissed Do No Harm’s case because it concluded that Do No Harm lacks standing. Do No Harm later filed an appeal to the U.S. Court of Appeals for the Second Circuit and the case is now pending there. Both Do No Harm and Pfizer submitted their briefs before the court. 

In October 2023 Do No Harm argued its first appeal before the U.S. Court of Appeals for the Second Circuit in New York. In March 2024, despite established precedent, the Court ruled that we must identify our injured member by name to have standing for the case. On January 10, 2025, the Second Circuit granted our request for rehearing and affirmed our standing to sue on behalf of our anonymous members. We look forward to continuing our fight to oust corrosive identity politics wherever it exists in medicine.
